AddFone - Terms of Service for Your Personal Use
By using AddFone's search engine ("Service"), you agree to be bound by the following terms and conditions ("TOS"), just as if you had signed this Agreement. If you do not comply with the Terms of Service at any time, AddFone reserves the right to terminate your access to the AddFone Service. AddFone may discontinue or alter any aspect of the AddFone Service, including, but not limited to, (i) restricting the time the AddFone Service is available, (ii) restricting the amount of use permitted, and (iii) restricting or terminating any user's right to use the AddFone Service, at AddFone's sole discretion and without prior notice or liability. You are responsible for all charges associated with connecting to the AddFone Service through an available access number. You are also responsible for obtaining or providing all access lines, telephone and computer equipment (including modem), or other device, necessary to access the AddFone Service. You further certify that you are an individual.

The sites displayed as search results or linked to by AddFone search engine are developed by people over whom AddFone exercises no control. The search results that appear from AddFone's indices are indexed by AddFone's staff or automated processes using computers and AddFone cannot and does not screen the sites before including them in the indices from which such automated search results are gathered. A search using AddFone Services may produce search results and links to sites that some people find objectionable, inappropriate, or offensive. We cannot guarantee that a AddFone search will not locate unintended or objectionable content and assume no responsibility for the content of any site included in any search results or otherwise linked to by the AddFone Services.

The AddFone Services are made available for your personal, non-commercial use only. You may not use the AddFone Services to sell a product or service, or to increase traffic to your Web site for commercial reasons, such as advertising sales. This means that you, and not AddFone, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. AddFone does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will AddFone be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

You agree to not use the Service to: upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; harm minors in any way; impersonate any person or entity, including, but not limited to, a AddFone official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity; forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service; upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party; upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas (such as shopping) that are designated for such purpose (please read our complete Spam Policy); upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges; interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the European Union Laws any rules of any national or other securities or regulations having the force of law; provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the European Union states as a foreign terrorist organization; "stalk" or otherwise harass another; and/or collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs a through m above.

THE ADDFONE SERVICES, AND ALL MATERIALS, INFORMATION, PRODUCTS AND SERVICES INCLUDED IN THE ADDFONE SERVICES ARE PROVIDED "AS IS," WITH NO WARRANTIES WHATSOEVER. ADDFONE AND ITS LICENSORS EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. ADDFONE AND ITS LICENSORS DISCLAIM ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE ADDFONE SERVICES. ADDFONE AND ITS LICENSORS DISCLAIM, ANY WARRANTIES FOR ANY INFORMATION OR ADVICE OBTAINED THROUGH THE ADDFONE SERVICES. ADDFONE AND ITS LICENSORS DISCLAIM ANY WARRANTIES FOR SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE ADDFONE SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED BY THE ADDFONE SERVICES, AS WELL AS FOR ANY INFORMATION OR ADVICE RECEIVED THROUGH ANY LINKS PROVIDED IN THE ADDFONE SERVICES.

Disputes. If there is any dispute about or involving the ADDFONE Services, you agree that the dispute shall be governed by the laws of Portugal (European Union), without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in the national courts of Portugal in the European Union. Either ADDFONE or you may demand that any dispute between ADDFONE and you about or involving the ADDFONE Services must be settled by arbitration utilizing the dispute resolution procedures of the portuguese court, provided that the foregoing shall not prevent ADDFONE from seeking injunctive relief in a court of competent jurisdiction.

Indemnity. You agree to indemnify and hold ADDFONE, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the ADDFONE Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or if any Content that you post on the ADDFONE Website or through the ADDFONE Services causes ADDFONE to be liable to another.
